Omnibus Hazardous Waste Act of 1991
- P2 Objective: To require mandatory P2 planning by hazardous waste
generators.
- Numeric Goal: 20% reduction within 2 years, 50% within 5 years, and 70% within
10 years.
- Assistance Offered: Creates a specific program within the department for technical
assistance. No grants program mandated.
- Reporting Requirements: Toxic Data Report, Pollution Prevention Plan, Annual
Progress Report.
- Incentives: Hazardous waste management fees reduced for P2 planners.
- Funding: Hazardous Waste Management Fund, consisting of fees and appropriated
monies.

Definitions
Hazardous waste -- Garbage, refuse, sludge from a waste treatment plant, water
supply treatment plant or air pollution control facility, or other discarded materials, including
solid, liquid, semisolid or contained gaseous material, resulting from industrial, commercial,
mining and agricultural operations or from community activities which because of its quantity,
concentration or physical, chemical or infectious characteristics may cause or significantly
contribute to an increase in mortality or an increase in serious irreversible or incapacitating
reversible illness or pose a substantial present or potential hazard to human health or the
environment if improperly treated, stored, transported, disposed of or otherwise managed.
Pollution -- The disposal of a toxic substance or hazardous waste into the air, land,
surface water or groundwater.
Pollution Prevention -- Operational procedures, processes, and improvements in
housekeeping or management techniques that reduce potential or actual releases of pollutants to
the overall environment including all air, water and land resources affected by those pollutants.
This includes:
a. toxics use reduction, source reduction, recycling of wastes or secondary materials, waste
minimization, reuse, reclamation, conservation and substitution.
b. proportionate changes in the total volume, quantity or toxicity of a particular pollutant as a
result of production changes or other business changes (such as improvements in operating
practices, spill and leak prevention measures, inventory control). This does not include transfer
or relocation of an operation or process to another facility with no subsequent proportionate
reduction in toxics use or release of pollutants.
c. On-site or off-site treatment if that treatment can be shown to confer a higher degree of
protection to overall public health and safety than other technically and economically practicable
waste reduction alternatives.
