Toxic Waste Reduction Release Act of 1990 (as amended 1991 and
1993)
- P2 Objective: To reduce the amount of toxic substances used by
mandating reporting requirements for toxic users, toxic releasers, and hazardous waste
generators.
- Numeric Goal: Waste reduction by users, releasers, and generators of 10% by 1,
1994, 20% by 1, 1996, and 30 % by 1, 1998 (using different baseline years for users, releasers,
and generators).
- Assistance Offered: Establishes a specific program in the state agency for technical
assistance.
- Reporting Requirements:Toxics Use Reduction, Toxic release Reduction and
Hazardous Waste Reduction Plan; Progress report and Plan Summary.
- Incentives: Awards program administered by the Pollution Prevention Office.
- Funding: Hazardous Waste Fund, consisting of annual fees and penalty fees, and
used for administration of this Act.

Definitions
Toxic substance or toxics -- Any substance in a gaseous, liquid or solid state listed
pursuant to SARA, Title III, Section 313 and listed in 40 CFR 372.65 and any extremely
hazardous substance listed in 40 CFR 355.
Toxics use reduction -- Front-end substitution, product reformulation or in-plant
changes in production processes or raw materials that reduce, avoid or eliminate the use of toxics
or the generation of toxic by-products per unit of product to reduce risks to the health of workers,
consumers or the environment, without shifting risks among workers, consumers or parts of the
environment.
Toxics user -- Owners and operators of facilities subject to reporting requirements for
extremely hazardous substances under SARA, Title III, Section 312.
Toxic releaser -- An owner or operator of a facility that is required to report under
SARA, Title III, Section 313.
Hazardous waste generator -- Owner or operator of a facility that generated waste
determined by the Board of Environmental Protection to be hazardous.
